Board of Adjustment
The City of Douglas Board of Adjustment is a seven member citizen board appointed by the Mayor and Council and has the authority to consider and approve, approve with conditions, or deny, request for a variance from certain standards of the City Zoning Code, such as setback requirements, height limitations, buffer requirements, parking requirements, sign regulations. The Board of adjustment also considers and approves Conditional Use Permits and appeals from the decision of the planning staff.

General Procedures of the Board of Adjustment Public Hearing
- The Board of Adjustment Chairman identifies the case to be considered.
- The Planning Division staff will introduce the case, report findings of fact, and response to the notification, present a staff report and make a recommendation.
- The applicant will be called on to state their name, address, and give brief explanation of their request.
- Any others in support/opposition of the application will be given an opportunity to speak.
- The Board of Adjustment members discuss the case and vote.
Appeals from Decisions of the Board of Adjustment
Any person aggrieved by a decision of the Board of Adjustment, any taxpayer, or a municipal officer may, at any time within thirty (30) days after the filing of the decision by the Board of Adjustment, file a complaint for special action in the superior court to review the Board decision. Filing of the petition shall not stay proceedings upon the decision appealed from, but the court may, on application, on notice to the Board of Adjustment, and for good cause shown, grant a restraining order, and on final hearing may reverse, affirm, or modify the decision reviewed.
