The Historical Preservation and Design Review Overlay Zones are intended to protect and enhance the distinctive character and historic significance of various sections of the City. It is also intended to protect and preserve buildings of unique, characteristic architecture. Preservation of historical areas and buildings is a significant factor contributing to the social and economic welfare of inhabitants. The creation of these districts is therefore considered to be in furtherance of the health, safety and general welfare of the City. The Design Review Board is a seven-member citizen board appointed by the Mayor and Council, which acts upon the appeals and requests in Historical Preservation and Design Review Overlay zones. The powers of this board are limited to the appearance and character of properties within these zones.
General Procedures of the Design Review Board Public Hearing
Appeals from Decisions of the Design Review Board Any person, aggrieved by a decision of the Design Review Board, any taxpayer, or a municipal officer may, at this time within thirty (30) days after the filing of the decision by the Design Review Board, file a complaint for special action in the superior court to review the Board decision. Filing of the petition shall not stay proceeding upon the decision appealed from, but the court may, on application, on notice to the Design Review Board, and for good cause shown, grant a restraining order, and on final hearing may reverse, affirm, or modify the decision reviewed.
